AIFAME MAGAZINE

For privacy-related enquiries, please contact:
privacy.aifamemagazine@online.de

Further information about the website operator can be found in the Legal Notice.

2. General Information on Data Processing

AIFAME MAGAZINE processes personal data only where this is necessary to operate the website, communicate with visitors, process editorial enquiries and submissions, manage collaborations, document permissions and approvals, and ensure the security and administration of the website.

Depending on the individual processing activity, personal data may in particular be processed on the basis of Article 6(1)(a) GDPR (consent), Article 6(1)(b) GDPR (performance of a contract or steps taken prior to entering into a contract), Article 6(1)(c) GDPR (compliance with a legal obligation), or Article 6(1)(f) GDPR (legitimate interests).

Where processing is based on legitimate interests, these interests may include the secure and efficient operation of the website, communication with users and creators, editorial organisation, documentation of collaboration processes and the protection of AIFAME’s legal interests.

3. Hosting

This website is hosted by IONOS SE, Elgendorfer Str. 57, 56410 Montabaur, Germany.

When the website is accessed, technically necessary connection and access data may be processed by the hosting provider. This may include, depending on the technical configuration, requested page or file, date and time of access, browser type and version, operating system, device information, referrer information and IP-related connection information.

Such processing is necessary to provide the website securely, reliably and efficiently. The legal basis is Article 6(1)(f) GDPR, based on our legitimate interest in the secure and technically stable operation of AIFAMEMAGAZINE.COM.

4. WordPress and Internal Website Systems

AIFAME MAGAZINE uses WordPress as its content management system and operates internal WordPress-based editorial and creator-management components.

These systems may process data necessary for website administration, security, session management, communication, collaboration management and proper website functionality. The public website is currently not designed to create advertising profiles of visitors.

5. Cookies and Similar Technologies

Based on the current configuration, AIFAME MAGAZINE does not intentionally use advertising or behavioural tracking systems such as Google Analytics or Meta Pixel.

Technically necessary cookies or similar technologies may nevertheless be used where required for website functionality, security, session management, administrative access or a feature explicitly requested by the user.

Where the use of a non-essential cookie or comparable technology requires consent under applicable law, such technology will only be activated after the required consent has been obtained.

If additional analytics, marketing, embedded-media or tracking services are introduced in the future, this Privacy Policy and, where necessary, the website’s consent mechanism will be updated accordingly.

6. Contacting AIFAME

Users may contact AIFAME through the website’s contact system. Depending on the selected route, the following information may be collected: name, email address, Instagram or other social media information, portfolio information, project or work links, message content and other information voluntarily provided by the user.

The CONTACT page currently provides the following routes: General Contact, AIFAME MAIN, AIFAME NEXT, AIFAME AI-INTERVIEW, Editorial Collaboration and Creative Collaboration.

The first contact request is used to receive, organise, review and respond to the enquiry. Extensive project materials are generally requested only after a collaboration has been accepted or otherwise moved into a project-specific submission process.

Contact enquiries may be stored within AIFAME’s internal systems and may also be processed through AIFAME’s email infrastructure. The system may send transactional messages such as confirmations of receipt.

Where an enquiry relates to a potential contractual or professional relationship, processing is based in particular on Article 6(1)(b) GDPR. For general enquiries, processing may be based on Article 6(1)(f) GDPR, based on our legitimate interest in responding to communications addressed to AIFAME.

7. Creator Contacts, Project-Specific Submissions and Creator Data

AIFAME uses an internal Creator Contacts system to organise creator enquiries and collaborations. The public workflow does not require creator accounts, public creator dashboards, passwords or ordinary creator logins.

After a collaboration has been accepted, AIFAME may provide the creator with a secure project-specific submission link. Depending on the relevant collaboration, Creator Data may include: name, artist or creator name, email address, social media profiles, portfolio information, project links, questionnaire answers, messages, project descriptions, Model Cards, reference images, photographs, cover artwork, press or campaign materials, documents and other information voluntarily submitted by the creator or an authorised representative.

Creator Data is processed to review and manage the relevant collaboration, communicate with the creator, organise editorial production, document approvals and permissions, prepare publication and maintain an internal collaboration history where necessary.

Where a specific collaboration is requested, prepared or performed, processing may be based on Article 6(1)(b) GDPR. Editorial organisation, fraud prevention, duplicate detection, internal documentation and other necessary administrative activities may also be based on Article 6(1)(f) GDPR where applicable.

8. Creator Cards and Collaboration Records

For accepted collaborations, AIFAME may maintain an internal Creator Card. A Creator Card can contain creator contact details, collaboration history, project references, consent or permission records, internal notes, message history and references to files submitted for the relevant projects.

Creator Cards are intended to avoid unnecessary duplicate collection of the same basic information and to support future or repeated collaborations. They are not publicly visible.

Creator and project records are retained only for as long as necessary for the relevant collaboration, ongoing professional relationship, documentation of permissions and approvals, legal obligations, or the establishment, exercise or defence of legal claims. They are reviewed separately from ordinary message retention and are not automatically deleted merely because an inbox message reaches the end of its retention period.

9. Project Files and Protected Uploads

Project-specific submissions may include Model Cards, images, PDFs and other documents. Private creator uploads are stored separately from ordinary public publication assets and are delivered through access-controlled internal mechanisms rather than ordinary public media URLs where technically applicable.

Authorised AIFAME users may preview, download, add or delete project files within the internal Creator Contacts workflow. Where project files are deleted through the system, the associated internal record and protected stored file may also be removed.

If a submitted image or other material is selected for publication, AIFAME may create or retain a separate publication copy as part of the relevant editorial publication. Publication copies are managed independently from the private submission workflow.

10. Project-Specific Permission and Consent Records

For project-specific submissions, AIFAME may request confirmation that the creator owns, controls or is otherwise authorised to provide the submitted AI Character references, Model Cards, visual materials and other project assets, and that AIFAME MAGAZINE and/or AIFAME STUDIO may use the submitted materials for the specific collaboration.

Such project-specific permission does not by itself transfer ownership of the creator’s character, images or other materials to AIFAME. The exact scope of use depends on the relevant collaboration and the permission granted for that project.

Where consent is used as the legal basis for processing personal data, it may be withdrawn with effect for the future, subject to applicable law. Records documenting permissions, approvals or licences may be retained where necessary to demonstrate the lawful use of editorial materials or to protect legal claims.

11. Messaging and Email Communication

AIFAME may communicate with creators through its internal messaging workflow and by email. Depending on the communication, data such as email address, sender and recipient information, date and time, subject, message content, project reference and voluntarily submitted attachments may be processed.

AIFAME currently uses email infrastructure within the 1&1 / IONOS environment. Transactional emails may be sent in connection with contact requests, project submissions, collaboration status changes and other creator-related actions.

Messages held in the internal Creator Contacts messaging workflow may remain in the active inbox for approximately 14 days and may then be archived. Archived message records are generally intended to be retained for up to 365 days, unless a longer period is necessary for an ongoing collaboration, legal obligation or the establishment, exercise or defence of legal claims.

Copies independently retained within the technical email infrastructure may be subject to separate technical, contractual or legal retention requirements.

12. Ending a Collaboration

A creator may be provided with a project-specific option to end a collaboration. If this function is used, AIFAME may record the project status, date and any reason voluntarily supplied by the creator, and may create an internal notification or project note for organisational and documentation purposes.

Ending a collaboration does not necessarily require immediate deletion of all records where continued retention is necessary to document prior permissions, completed editorial work, legal obligations or claims. Data that is no longer required will be deleted or anonymised in accordance with the applicable retention rules.

13. Internal AI and Editorial Systems

AIFAME uses internal editorial, administrative and AI-assisted tools to support its editorial workflow. These systems may include AIFAME-developed WordPress components and secure technical interfaces used by authorised AIFAME users.

The mere act of visiting AIFAMEMAGAZINE.COM does not, based on the current configuration, automatically result in contact or creator data being transmitted to an AI provider solely because a visitor accesses the website.

Where authorised AIFAME users intentionally use an AI-assisted service in connection with a specific editorial or administrative task, information may be processed through that service where necessary for the relevant purpose. AIFAME may use services provided by OpenAI as part of its internal editorial and administrative workflow.

Where personal data is involved, AIFAME seeks to limit processing to information required for the relevant task and to use appropriate technical and organisational safeguards. Editorial decisions, creator approvals and publication decisions are not made solely by automated systems with legal or similarly significant effects on individuals. Human editorial oversight remains part of the AIFAME workflow.

14. Social Media Links

AIFAMEMAGAZINE.COM may contain links to Instagram profiles and other external social media services.

Where social media profiles are provided only as normal external links and are not directly embedded into the website, visiting an AIFAME page does not itself require the user to open the respective social media platform.

If a user chooses to follow such a link, the privacy rules and data processing practices of the respective external provider apply. AIFAME has no control over the processing of personal data carried out independently by those external platforms.

15. Recipients of Personal Data

Personal data is only disclosed where this is necessary for the relevant purpose or otherwise legally permitted.

Possible recipients may include hosting providers, email service providers, IT and security service providers, authorised technical service providers, cloud service providers, AI service providers where used for a specific authorised task, and public authorities where disclosure is legally required.

AIFAME does not sell personal data to advertisers or other third parties.

16. International Data Transfers

Some technical or AI service providers may process data outside the European Economic Area.

Where personal data is transferred to a country outside the EEA, AIFAME will rely on an applicable legal transfer mechanism where required, such as an adequacy decision by the European Commission, Standard Contractual Clauses or another legally recognised safeguard under the GDPR.

17. Storage and Deletion

AIFAME stores personal data only for as long as it is necessary for the purpose for which it was collected.

Ordinary internal message records are handled separately from Creator Cards, project records, consent or permission evidence and project files. Message records may be archived after approximately 14 days and are generally intended to be deleted after up to 365 days, subject to necessary exceptions.

Creator Cards, project records, permission records and project files may be retained for different periods where this is necessary for an active or recurring collaboration, documentation of licences or approvals, statutory retention obligations, editorial record-keeping, or the establishment, exercise or defence of legal claims.

Published AIFAME editorial content and publication assets are not automatically removed merely because a private contact message or submission record is deleted.

18. Rights of Data Subjects

Subject to the requirements of applicable law, individuals whose personal data is processed may have the following rights: right of access, right to rectification, right to erasure, right to restriction of processing, right to data portability where applicable, right to object to processing based on legitimate interests, right to withdraw consent at any time with effect for the future, and right to lodge a complaint with a competent data protection supervisory authority.

Requests relating to personal data may be sent to:
privacy.aifamemagazine@online.de

19. Right to Object

Where personal data is processed on the basis of Article 6(1)(f) GDPR, the data subject has the right to object to such processing on grounds relating to their particular situation in accordance with Article 21 GDPR.

If personal data is ever processed for direct marketing purposes, the data subject has the right to object to such processing at any time.

20. Supervisory Authority

Without prejudice to any other administrative or judicial remedy, data subjects have the right to lodge a complaint with a competent data protection supervisory authority.

For the website operator in Hesse, the relevant supervisory authority is in particular:

The Hessian Commissioner for Data Protection and Freedom of Information
Der Hessische Beauftragte für Datenschutz und Informationsfreiheit
Wilhelmstraße 7
65185 Wiesbaden
Germany

21. Data Security

AIFAME implements appropriate technical and organisational measures designed to protect personal data against accidental or unlawful loss, unauthorised access, unauthorised disclosure, alteration and other unlawful processing.

Access to administrative and editorial systems is restricted to authorised users. Private Creator uploads are kept separate from normal publication assets where technically applicable and are handled through restricted Creator Contacts storage and access controls.

22. Changes to this Privacy Policy

AIFAME may update this Privacy Policy where necessary due to changes to the website, technical systems, service providers, internal workflows or applicable legal requirements.

The current version will be made available on AIFAMEMAGAZINE.COM.
